UM Law School Professor Stephen I. Vladeck Presents Paper at the Temple Law Review Symposium Entitled: “Executive Power: Exploring the Limits of Article II”

Stephen I. Vladeck, law professor at the University of Miami, explored key issues in his paper "Executive Power:Exploring the Limits of Article II" at the Temple Law Review Symposium on Friday, March 23.
Scholars and practicing attorneys debated over the ever-expanding nature of executive power, concentrating on the Supreme Court opinion in Hamdan v. Rumsfeld, which asserted that the Bush administration violated the UCMJ and Geneva Conventions when it tried detainees at Guantanamo Bay. The panel also explored issues related to the State Secrets Privilege, which allows the president to block information disclosure.
Executive power is an important topic to explore, especially since we are now dealing with Karl Rove and the seemingly arbitrary dismissal of eight government attorneys. Many legal scholars, such as University of Texas law professor Sanford Levinson, now think President Bush will use his executive power to protect his right-hand man, Karl Rove, from an impending Congressional subpoena.
It worries me that executive power seems to be expanding with no end in sight. Not only is it counteracting the benefits of our nation’s checks and balances, but it also seems to highlight the party lines that divide our government. In recent cases such as United States v. Libby, with regard to the Iraq War, and in the aforementioned Rove case, the Democratic majority in Congress seems to be pitting itself against the Bush administration and Republican federal courts.
If executive power continues to expand, Congress will be rendered useless.
